These Terms of Use constitute a legally binding agreement made between you (“you”) and KJ Fit Lab LLC, doing business as The Training Station (“Company,” “we,” “us,” or “our”), concerning your access to and use of the www.trainingstation.org website, as well as any other media form, mobile application, or service related to or connected with it (collectively, the “Site”).

15. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of California, USA. Any disputes shall be subject to the jurisdiction of courts in Alameda County, California.

16. Dispute Resolution Before initiating legal action, both parties agree to attempt to resolve disputes through informal negotiation for at least 30 days. If unresolved, disputes will be settled through binding arbitration in Alameda County, California, under the rules of the American Arbitration Association (AAA), unless the claim qualifies for small claims court.

17. Disclaimer The Site is provided “as is” without warranties of any kind. We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Use the Site at your own risk.

18. Limitation of Liability We are not liable for any indirect, incidental, or consequential damages arising from your use of the Site. Our liability is limited to the amount you paid to us, if any, in the past six months.

19. Indemnification You agree to indemnify and hold harmless KJ Fit Lab LLC, its affiliates, and team members from any claims, losses, or liabilities arising from your use of the Site, your Contributions, your participation in physical activities, or violation of these Terms. Trainers and therapists using our facility agree to maintain active liability insurance and provide proof upon request.

20. User Data We may retain data you provide for Site operation. While we back up data regularly, we are not liable for any loss or corruption of such data.

21. Electronic Communications By using the Site, you consent to receive electronic communications and agree that digital agreements and signatures are legally binding.

23. Gym Use and Waiver of Liability By using The Training Station facility or participating in any in-person services, you acknowledge the risks involved in physical exercise, including but not limited to injury, illness, or death. You agree to assume all such risks and release KJ Fit Lab LLC, its employees, contractors, and agents from any liability arising from your use of the facility, unless caused by gross negligence or intentional misconduct. You affirm that you are physically capable and have consulted with a healthcare provider prior to participating.

24. Health Disclaimer The content provided on the Site or during in-person sessions is for informational purposes only and does not constitute medical advice. You should consult your physician or qualified healthcare provider before beginning any fitness or wellness program. Results are not guaranteed.

25. Miscellaneous These Terms constitute the entire agreement between you and us. Any failure to enforce a provision does not waive our right to enforce it later. If any provision is found unenforceable, the remainder remains in effect. These Terms do not create a joint venture, agency, or employment relationship.
